IMPORTANT: AGE REQUIREMENT

You must meet the minimum age required by the laws of your jurisdiction to use this app. This varies by location. For example, in the United States, the minimum age is 13 years old under COPPA. In many European Union member states, the minimum age is 16 years old under GDPR. In other jurisdictions, different age requirements may apply. It is your responsibility to know and comply with the minimum age requirement in your location.

Note for Minors: If you are above the minimum age required in your jurisdiction but below the legal age of majority (typically 18 years old), you represent that your parent or legal guardian has reviewed and agrees to these Terms on your behalf, and that you have their permission to use FutureHabit AI.

By creating an account or using FutureHabit AI, you represent and warrant that you meet the minimum age requirement applicable in your jurisdiction. If we discover that a user does not meet their local minimum age requirement, we reserve the right to terminate the account and delete all associated data immediately.

1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and FutureHabit AI LLC, a Florida limited liability company ("Company," "we," "us," or "our"), governing your access to and use of the FutureHabit AI mobile application (the "App") and any related services.

By downloading, installing, or using the App, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App.

2. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms within the App or by sending you an email notification. Your continued use of the App after such modifications constitutes your acceptance of the updated Terms. We encourage you to review these Terms periodically. The "Last Updated" date at the top of this document indicates when these Terms were most recently revised.

3. Description of Service

FutureHabit AI is a mobile wellness and habit tracking application that provides users with tools to track daily habits, log daily scores using emojis, view calendar-based progress, and receive AI-powered insights about their patterns and behaviors.

Free Features: Access to the last 7 days of calendar history, basic habit tracking functionality.

Premium Features: Full calendar history, up to 3 tracked habits, AI-powered insights for 7-day, 30-day, and 90-day periods, and future letters feature.

4. Account Registration

To use certain features of the App, you must create an account. When you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You agree to notify us immediately of any unauthorized use of your account. We are not liable for any loss or damage arising from your failure to protect your account credentials.

5. Subscriptions and Payments

FutureHabit AI offers premium features through in-app subscriptions. Subscription pricing is displayed within the App and is subject to change. Any price changes will apply to subsequent billing cycles, not your current subscription period.

All payments are processed through the Apple App Store or Google Play Store, depending on your device. By subscribing, you agree to the payment terms presented at the time of purchase.

Subscriptions automatically renew unless canceled at least 24 hours before the end of the current billing period. You may manage and cancel your subscription through your Apple App Store or Google Play Store account settings.

Refunds: All refund requests must be directed to Apple or Google, as applicable, in accordance with their respective refund policies. FutureHabit AI LLC does not process refunds directly.

6. Artificial Intelligence Features

The App uses artificial intelligence technology provided by Google (Gemini) to analyze your habit data, journal entries, daily scores, and other information you provide in order to generate personalized insights and content.

You acknowledge and agree that:

AI-generated insights and content are provided for informational and motivational purposes only and do not constitute professional medical, psychological, financial, or other professional advice;
AI-generated content may not always be accurate, complete, or appropriate for your specific situation;
You should not rely solely on AI-generated content for important life decisions;
Your data will be processed by third-party AI services as described in our Privacy Policy.

7. User Content and Conduct

You retain ownership of any content you create or submit through the App, including journal entries, habit names, and other personal data ("User Content"). By submitting User Content, you grant us a limited license to use, process, and store such content solely for the purpose of providing and improving the App's services.

You agree not to:

Use the App for any unlawful purpose or in violation of any applicable laws;
Attempt to gain unauthorized access to any part of the App or its systems;
Interfere with or disrupt the App's functionality or servers;
Reverse engineer, decompile, or disassemble any part of the App;
Use the App to transmit malware, spam, or other harmful content.

8. Intellectual Property

The App, including its design, features, graphics, and all related intellectual property, is owned by FutureHabit AI LLC and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes in accordance with these Terms. This license does not include the right to modify, distribute, sell, or create derivative works based on the App.

9. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the App will be uninterrupted, error-free, or free of viruses or other harmful components. We do not warrant the accuracy, reliability, or completeness of any AI-generated content or insights.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, FUTUREHABIT AI LLC AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (A) YOUR USE OR INABILITY TO USE THE APP; (B) ANY UNAUTHORIZED ACCESS TO OR USE OF OUR SERVERS AND/OR ANY PERSONAL INFORMATION STORED THEREIN; (C) ANY AI-GENERATED CONTENT OR INSIGHTS; OR (D) ANY OTHER MATTER RELATING TO THE APP.

11. Indemnification

You agree to indemnify, defend, and hold harmless FutureHabit AI LLC and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your access to or use of the App, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We reserve the right to suspend or terminate your account and access to the App at any time, with or without cause, and with or without notice. Upon termination, your right to use the App will immediately cease.

You may terminate your account at any time by deleting your account through the App or by contacting us at hello@futurehabit.app. Upon termination, we will delete your personal data in accordance with our Privacy Policy.

13. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, United States, without regard to its conflict of law provisions.

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through good-faith negotiations. If such negotiations fail, the dispute shall be resolved through binding arbitration in the State of Florida, in accordance with the rules of the American Arbitration Association.

14. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

15. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and FutureHabit AI LLC regarding your use of the App and supersede all prior agreements and understandings.
